I want to make sure I have this straight. Ninth Circuit Court of Appeal Judge Mary Schroeder ruled that "Congress had the right to intervene when it stripped protections from wolves...."
However, on February 15, 2012, in connection with an Emergency Petition for a First Amendment Writ requesting the court to render a decision on whether two permanent injunctions issued against Journalist, Erin Baldwin, were unconstitutional prior restraints of her protected speech ...
Judge Mary Schroeder (along with Judges Leavy and Clifton) wrote an Order that stated:
"Petitioner has not demonstrated that this case warrants the intervention of this court by means of the extraordinary remedy of mandamus."
So does that mean that wolves have more rights than American citizens? Or is that just on a full moon?
A petition for rehearing is on the desk of Judge Schroeder as we speak. See it here: http://www.scribd.com/doc/83354367/Ninth-Circuit-Denied-Baldwin-s-First-Amendment-Rights-Baldwin-Files-Emergency-Petition-for-Rehearing
