Tweet Share on Facebook June 30, 2011 Comment (18)By a vote of three to two, a three-judge panel of the Sixth Circuit Court of Appeals upheld Wednesday the constitutionality of the individual mandate to buy heath insurance that is the cornerstone of Obamacare.
In a blow to those who argue the mandate is an overreach of federal government power, Judge Boyce F. Martin Jr., writing for the majority, said, “We find that the minimum coverage provision is a valid exercise of legislative power by Congress under the Commerce Clause.”

Supreme Court: Only EPA Can Regulate 'Greenhouse Gas' Emissions

The court ruled 8-0 in American Electric Power Co. v. Connecticut that the federal Clean Air Act gives the EPA the lone authority to regulate the emission of so-called greenhouse gasses that, some suggest, lead to global warming. Obama-appointed Justice Sonia Sotomayor did not participate because she had been part of the Second U.S. Circuit Court of Appeals panel, whose ruling was being appealed.
