Great, and what is YOUR great alternative to the medical disaster in this country. This was not the original "Obamacare" that was initially introduced/requested/presented but was the end result of alllllll you politicians creating your own "fat" to grease your states that was the end result. You must think ALL americans are stupid just because a few are!

I'm a gun carrying old Marine that has paid my way my whole life. If you are really sucking it up and willing to die at home instead of going in for that medicaid liberal crap, I salute you.

Sorry that you feel personal attacks are a discussion. I have no problem with you having a different opinion than me. I would prefer to dicuss the issue of an individual's right to choose not to have insurance versus the rights of the insured and taxpayers who are paying for the uninsured person's care.

Hey Liberals! It's abour our "right to choose". What don't you understand about that?

Yes Congress has right to tax. Not for something you don’t do. If I don’t earn $$$ 10,000,000 I can not be taxed for that.

Is not my responsibility to “ check out any number of law school sites”. Is yours responsibility to provide your proof.

Supreme Court will certainly settle it by hearing the case or not. Is their choice.

The judge based his ruling on his interpretation of the Commerce Clause. The problem is that the law is based upon Congress's power to levy taxes, which the courts, including the USSC, have long and vigorously upheld. That's why "enforcement" is vested with the IRS, and not the Dept of Health & Human Services.

No one is forced to buy insurance under the law, but if you choose not to, the IRS levies a tax. It's a tax on uninsured people. If you check out any number of law school sites, you'll find that many Constitutional law scholars feel that the judge's decision is almost certain to be reversed on appeal.

I'm not saying I support the law or its underpinnings. I'm just pointing out why I think the judge's ruling won't be sustained.

Ted of AZ comments made the wheels fall off your metaphore.

There's no rational justification for the imposition of mandatory health care and compulsory taxation to fund it.

I believe justice will prevail and that the Constitution trumps Obama/Reid/Pelosi's social engineering.

If not, then I suspect we will see a middle age accountant disguised as an indians and storming Bethesda Medical Center in the dark of night to throw bandages, syringes and gurney's into the street.

The uber progressive, liberal left lampoons and belittles todays Tea Party affiliates. Yet, from the other side of their mouth they pretend that they are the true conservators of the American spirit and adopt themselves as linage from the loins of early American patriots. I have news for them. They may have roots to the American revolution, but their roots go to Tories, loyalists, turn coats, and Benedict Arnolds of yester year.

If the same thing happened today our progressive liberal left would would have snitched to the British. They would have helped round them up, demanded they be categorized as social terrorists and criminalized them for their civil unrest. They would have spared no expense to have them thrown in prison.

You can avoid paying car insurance by not driving a car. The Obama law makes you buy health insurance, period. You can't opt out as you can by not driving a car, thus not buying car insurance.

Interesting though is the thot on Medicare; you are forced to pay into that whether you want to or not. Can that be unconstitutional?

ted of AZ 10:32AM December 16, 2010

The government hs coerced people into Medicare since 1964, by daring them to wait until later and pay a higher premium which many retired people could not afford. How is this coercion considered legal?

Jim of IN 9:54AM December 16, 2010

States mandate vehicle insurance for all drivers (or pay into a fund). I support the federal government doing the same regarding health insurance, especially given the public health aspect of health insurance. Mandated health insurance will reduce the many insurance and co-pay dollars those who now have insurance pay for the now-uninsured.
