Just my two cents...It seems to me that as Americans we know so little of our Constitution that it's becomes nearly impossible to have a basic dialogue about the subject. Most Americans believe that the Constitution guarantees their right to do whatever and say what ever they feel might be right or expedient at the time. It should surprise no one that Sotomayor and others like her view the Constitution as an 'evolving document'.

How can a document, written in a time of many differences from the period in which we now live, remain the perfect guide for our governmental structure? Even the framers knew this when they constructed a specific process for the document's change. What we should not have is the Supreme Court changing the document. If we need change,we should use the amendment process to do it.

It is the Constitution that is to decide what is and is not "settled law". It was NEVER up to Supreme Court Judges to decide what "settled law" is. That is a FALLACY that too many have been hood-winked by. Supreme Court Justices take an OATH to UPHOLD what our Constitution declares---just as politicians do. If they do not abide by that "oath", then they need to be "impeached". There is NO OTHER common sense solution to the matter. No "gray areas" when it comes to upholding the Constitution of our nation.

Until 1973, the civil government spent huge amounts of tax revenue to force men and women to be compulsory parents. The Far Right represents Big Government, using the civil power to enforce Canon 2350, the Catholic Church law that bans abortion. The number of Canon 2350 changed but the law is the same. Canon Law bans abortion and attempted self-destruction. These church laws exist because each conception is thought to be a POTENTIAL CONVERT. If the conception is not aborted, the pregnancy might produce a person who will pay the ten per cent lifetime tithe to a church. If the person pays 10% of a steady annual wage of $40,000 over 40 years, that's $160,000. I'm scolded for calling attention to this connection between MONEY and Pro-Life, but it exists. Read the Code of Canon Law. It says the church has the right, independent of the civil power, to collect money to support the church. It tells exactly who is to pay that money--it is to come from church members. In the 1980's, The Humanist published my article saying the Catholic Church violates church law and civil law when it takes religious tax exemption. Congress is packed with Creationists, so this violation of civil law continues.

If the constitution were the extent of settled law, why would we be arguing about so many legal issues? The law is NEVER completely settled. Why else is the Talmud so large and unwieldy?

This comment must start with the reminder that the pope leads Ban Abortion political action. It incites interfaith attacks on abortion clinics. Men are affected by laws that force them to be fathers. The leading cause of death of pregnant women is being killed by the men who impregnate them. The U.S.A. in a cartoon, is Uncle Sam. The Vatican City State is the pope. As in a cartoon, I see the pope peering into a bedroom window, a Peeping Tom, when the word "privacy" is used in connection with reproduction. But the word "privacy" is being used to try to nullify Roe v Wade. I want to prepare lawyers to save Roe by publicizing the fact that it is about the MOBILITY of women--their freedom to MOVE AROUND, to GO where they want to go. They must be able to TRAVEL, to circumambulate, to create a change of scenery--to have freedom of action. Sen. Graham, a male who can never be pregnant and never know what it means to be a single mother belonging to a minority race, is on record for the way he attacked the nominee. He seems to want pregnant American women to stay at home like all Muslim women, until a male relative lugs them around,

The constitution is the greatest document ever written and it certainly does not need to be altered at this stage with trivial amendments. However, the world is changing and will always change. The founding fathers were well aware of this and designed the constitution with enough lack of rigidity to allow interpretation. This is why we have a supreme court.

This is all beside the point though. Terms like "settled law" have lost their meaning. Now these are code words for political types to use to try and gain advantage for their personal agendas. Justice is blind because she can't stand to watch this crap. William F. Buckley Jr. was a truly honest conservative. Where are the William F. Buckley Jr.s now?
