When Justice Breyer responded to the young girls suit against strip searching by describing boys' high school locker room antics as amusing (esp. to Justic Thomas)and therefore equivalent, Judge Gisburg exploded and so would have Justice O'Connor. Judge Sotomayor has declared that she tries to put aside her experiences in judging the law in the case. Clearly the teen-age experiences of these men are very active in coloring their assumptions of acceptable behavior even as they pretend to be the purist of jurists.

No greater argument exists than this story for the need for a woman with diverse life experiences to help provide justice for all in a diverse country.

Just out of curiousity how does putting the best qualified person to do the job fit into that role? I am not saying that men or better or worse than women in any situation. I just wanted to know when being the right race or gender for job outweighed the most qualified? If a woman of color is the most suited for the job I will accept that since it is not my decision to make. But I feel like whoever is appointed should be there on merit and experience. (Just out of curiousity do people not trust Obama to make the right decision regardless of race or gender?)

to name women to the next four vacancies on the Supreme Court---since one of those seats would probably be Justice Ginsburg's.

Maybe Obama will do just that in 8 years.

Maybe, too, with some luck, one of the vacancies would even be Scalia or Thomas.
