The Florida Ballot Project did a complete recount of all the ballots not counted by the voting machines. The result of that vote count was that Gore had more votes. Had the U.S. Supreme court not intervened to block the recount, Gore would have won. Several thousand U.S. families would not be going to the cemetary on Memorial Day to visit their son or daughter, or mom or dad.

Peter is exactly right. The case Mrs. Erbe states is not the same as overturning a written law to suite your political beliefs. Every major law in the USA for the past 30 to 40 years is a direct result of the Supreme Court (I am not saying they made the wrong decisions all the time, just stating a fact.) Our country was not designed that way, new laws should go thru the proper channels is all I am saying. And the Supreme court should only be there to interpret the existing laws not change them as they see fit.

Earth to Bonnie--Bush won Florida. He had more votes on Election night and Gore never led, even after numerous recounts. Even by the Gore standard of selective recounts, Bush won the election. This was settled a long time ago. It's pretty pathetic that you have to cite this case as your example of conservative judicial activism. Judicial activism doesn't mean judicial interventionism. Judicial activism is the substitution of personal policy preferences for the written law, not overturning a lower court when they get it wrong.

This was a presidential election which in my opinion makes it

A) clearly a matter for federal consideration, and

B) clearly necessary that a decision be made to settle the matter as the government needed to get ready for the transfer of power. In no way would it have been desirable to even look like we might not have a president elect ready to take office by inauguration day. Also remember, the elctoral college votes in December so that was the true deadline by which the matter needed to be resolved.
