Americans don't "favor" gay marriage. This the same BS that CNN printed a year ago. What kind of people write these articles? I tolerate it nothing more, nothing less. Tolerate, deal with it, but not favor it...understand?

Unfortunately for you and your party, your article is simply incorrect. Your assertion that a 'majority of Americans' support gay marriage is based on polling done by various news organizations and doesn't rely on polling of voters. However, a Democratic polling firm, PPP (Public Policy Polling) has surveyed many battleground states and found that, contrary to your assertions, clear majorities (or at very least pluralities) of American voters in most states (particularly battleground states like Ohio, Michigan, Florida, Pennsylvania, Iowa, Virginia and North Carolina oppose making same-sex marriage legal. Indeed, their most recent poll for the states of Washington and California showed a near even split on the issue - quite remarkable for left-wing states.

PPP has a clear record of accuracy on not only this but other issues. For instance, they were one of the only pollsters to accurately predict that Maine would repeal their pro-gay marriage law at the end of 2009.

Put simply, you are way off in your analysis. If gay marriage so slam dunk, why do you suppose Obama STILL hasn't come out in support of it? Because he truly opposes it? Of course not! He won't come out because (1) he knows the vast majority of African-Americans - his fundamental base - oppose it and (2) most Americans in the battleground states are firmly against it.

This helps explain why pretty well all the major flashpoints in America on gay marriage are in far left states like Washington, New York, California, Maryland and New Jersey (with strong chances for ultimately keeping it banned in most of those states).

I can only see this issue helping the GOP in the 2012 elections and as far as SCOTUS is concerned, we can pretty much know that 4 justices (Scalia, Thomas, Roberts and Alito) will be firmly opposed to legalizing gay marriage, just as Randy Smith is. What will Anthony Kennedy do? There's a number of schools of thought on it but my best bet is that he'll do minimally invasive surgery on an issue that is still extremely controversial.

One may like to points out that Lawrence vs. Texas is a prototype for him to follow but bans on homosexual sodomy were in place in only a minority of states and was enforced pretty well nowhere. That's why there wasn't a lot of controversy over their being struck down. By sharp contrast, same-sex marriages are strictly forbidden in more than 40 states - and most states don't even want to consider revisiting that.

I am very skeptical that Justice Kennedy would want to not only rock the boat but capsize it by imposing same-sex marriages nationally.
