Despite the Obama administration's urges against hearing the case, the U.S. Supreme Court will consider whether judges have the power to discharge non-terrorist prisoners from Guantánamo Bay into the United States. The issue arose over the case of 17 detainees from a Chinese-Muslim group called the Uighers who were arrested in Pakistan and Afghanistan in 2001. The Washington Post reported that a federal court ruled for the detainees' release, yet a panel from the U.S. Court of Appeals protested, claiming that only executive or legislative powers could make the decision. The question you should ask us is what we want, not what is right. Based on the comments I read here and elsewhere we the public are experts on what we want but most of us don't have a clue about the legal and constitutional basis for answering this question, including me. One thing I do know, the Supreme Court won't make everyone happy with its decision.
