Barack Obama marked his first whirlwind day in office by circulating "a draft of an executive order that would close the detention facility at Guantánamo Bay, Cuba, within a year and halt all war crimes trials in the meantime," according to the Associated Press. It's not clear, however, what exactly would happen to the 245 detainees currently held at Guantánamo. "The big question," writes one expert, "is what to do with any detainees who are too dangerous or heinous to send home but who cannot be effectively prosecuted." Should Obama close the Guantánamo Bay detention facility? And is he right to assert that doing so is in the "interests of the United States and the interests of justice"? If Obama does close Guantánamo, what should happen to any dangerous prisoners being held there who can't be effectively prosecuted, if there are any?
