VISTA, Calif. (AP) — A California jury has found that a gunman was sane when he opened fire on an elementary school in San Diego County, wounding two girls.
Court officials say the jury reached the verdict Friday in the sanity phase of 42-year-old Brendan O'Rourke's trial. Jurors had reported a deadlock on Thursday but were instructed to try again.
The Oceanside man was convicted earlier of attempted murder and assault with a firearm.
Prosecutors say O'Rourke had a revolver, reloads, a gas can and matches in October 2010 when he jumped a fence and opened fire on crowded playgrounds at Kelly Elementary School in Carlsbad.
Two second-graders were shot in the arm before nearby construction workers grabbed O'Rourke.
He's scheduled to be sentenced on April 20.
