Correct, and that's why the case was DISTRICT OF COLUMBIA v. Heller. The District of Columbia is FEDERAL LAND controlled by the FEDERAL GOVERNMENT.

With due respect for te brilliance of Mr. Justice Scalia, in reasdiung many o his decisions I have found him to be on of the worst offenders in the practice of judicial activism.

No better example than the appointment of George W, Bush and Dick /cheney to the Presidency and Vice Presidency of the United States without any constitutional authority; and in fact in violation of the Tenth Amendment which reserved to the States powers ot granted to the federal government nor prohibited to the States.

Article II of the Constitution confers upon the State the right to determine the resultrs of the vote in a presidential election, but in the case of a tie, then, and in that even only shall the Congress shall have the authority with the House choosing the President and the /senate the Vice President.

The Supreme Court had no business interdering in the nternakl processes of th State of Florida or the rulings of its Courts regarding the election, and was therefore by its action, unlawfully amending the Constitution of the United states of Ameria.

Dan - sorry your lobotomy failed to cure your delusions. Scalia is by all measures a intellectual giant. Even his toughest idealogical enemies concede his brilliance. His constructionist views of the law, especially those on State's rights and the Constitution are a bulwark for the entire court and they offset the radical activism of Ginsburg. He loves to debate and unlike his left leaning colleagues, does not shy away from them. Maybe that is why the Left hates him so much. He rarely loses a debate on the law and the constitution.

Your typical of most liberals... when you run out of facts or common sense you attack your political enemies personally. Guess what, the country is starting to catch on to this tactic and it continues to backfire.

Justice Scalia prides himself on being a constituional purist. Interpet the constitution the way it was written back in the 1700s.But one only has to look at his opinion in the Univeristy of Michigan Affirmative action case or the Washington, D.C. gun case to recognize what a fraud he is. Justice Scalia has absolutely no integrity when it comes to making up history to support his point. He does not even try to a revisionist take on history, he just makes it up out of the blue. For example, the 2nd Amendment was enacted against the backdrop of the British Crown banning and confiscating the guns of the colonists out of a fear of revolt by the colonists against the crown. The 2nd Amendment was enacted to bar the Federal government, not the individual states from banning guns. Further, when read in conjunction with the Tenth Amendment which reserves all right, powers and privleges not specifically enumerated to belong to the Federal govenment, to the individual states.

Justice Scalia's created history of the 2nd Amendment was enacted to allow citizens to have guns to hunt with is pure fiction from the mind of a very delosional man who is totally in love with his own writing and wants to be the center of attention on the Court.

I used to think Justice Clarence Thomas was the weakest link on the Court but at least he is smart enough to keep his mouth shut, his pen in his pocket and not volunteer to write opinions. Fortuantely, the Chief Justice, past and present have recognized Justice Thomas's limited intellectual and writing abilities.
