Bush v. Gore was a 2000 case taking place after the 2000 election. Rehnquist was still CJ at that point, thus, your fact check fails.

FACT Check muser,

Alito and Roberts were confirmed after the 2004 election. The election you claim Rehnquist gave to bush, which resulted in alito and roberts, was not the same election cycle. Sorry the causal chain is broken, and your argument fails.

He wasn't a judge we'd expect in this position, but that's usually the case!

It is remarkable how many people, like Muser of NM, think that following the Constitution is a political act. Good thing they are not on the Supreme Court.

Jim of PA 8:40AM September 09, 2009

But overturning voters and the election business of a state in Bush v. Gore was unforgiveable. As I recall, the supposedly "great" Sandra Day O'Connor was on that majority, too.

As a result, you got Roberts and Alito shoved down your throat for decades. Talk about a "political" court. Republicans appoint justices who appoint a Republican to appoint more Republicans.

Forget the disqualifacation, he was a man of the lawm and did the right thing.

My jaw dropped! Pro ball players get banned for LIFE for betting even outside their own sport (that is, if they're caught), doesn't matter how much or how little. But the CHIEF JUSTICE of the highest court in the land can BET on political events, that then come before them? And on SCOTUS letterhead & fax machines AND time, to boot? I'm NOT saying he could be bought for a penny ante personal side wager, but I AM saying that placing them, even flaunting them, is WAY outa line, inappropriate, flip, and represents clear evidence of personal BIAS & pre-formed opinions. And cheesy. BTW, great friends this legendarily private man had, eh? Soon as you die, he profits, in the guise of affectionate tribute, by spreading your private eccenticities before the world. Classy.

100% in agreement with Dr. Dan!!

Rehnquist should have disqualified himself for placing a bet on the election. Typing a note to cancel his bet does not remove the impression of conflict of interest
