There are a number of training programs offered through the Utah State Bar Association. Look them up here: http://www.utahdisputeresolution.org/

It doesn't certify you as anything (there is no official certification as a mediator in Utah) but you are recorded as having recieved hours of mediation training. Combine that training with some observation and volunteer hours as a mediator and you can be listed on the Utah State Court Roster of Mediators. From there you can build clients depending on your specialties.

Mediation

I have been involved with mediation type scenarios before. I have been a Union officer for years as well as a certified Paralegal and have a certification in Civil litigation and have studied as well quite a few hours of alternative dispute resolution and Victims rights advocacy. However I have been looking for a training program for Mediators and cant seem to pin one down. I have been told that the Courts here in Utah have one but have been unsuccessful in getting in. Any suggestions ? Mike

I am considering enrolling in a Cal Berkeley extension course for a mediation/conflict resolution certificate. I am a career changer and would this certificate open doors and give me a start in this new field? CAS

Coalition for Mediation Awareness in Tennessee; Tipping Point Predictions

Given the high cost of full-blown litigation, mediation increasingly attracts clients. Lawyers recognize the value they provide through early case evaluation and settlement in appropriate cases. After all, a satisfied client is likely to return to the same lawyer the next time a dispute develops. Key issues for mediators are marketing and ethical standards.

So how can we increase public awareness of the benefits of mediation? One model is the Coalition for Mediation Awareness in Tennessee (CMAT), a loose network of state and local bar association ADR committees, community mediation centers, professional mediator organizations, educational institutions, and other supportive groups. I spearheaded CMAT’s formation with start-up support from the Tennessee Bar Association. At its annual event in October, CMAT presents the Grayfred Gray Public Service Mediation Award to a person who has made an innovative and lasting contribution to public service through alternative dispute resolution in Tennessee. The award is named after its first recipient, Grayfred Gray, Emeritus Professor, University of Tennessee School of Law, and founder of UT’s outstanding Mediation Clinic. Last year the award was presented to Tennessee Supreme Court Chief Justice Jannice Holder.

CMAT is just one indicator of mediation reaching the tipping point in public awareness. So two of my predictions for 2009-2010:

o An explosion of interest in time for the next International Conflict Resolution Day, celebrated annually on the third Thursday of October under the auspices of the Association for Conflict Resolution.

o Increasing attention to mediator standards and competence, a long-standing interest of the American Bar Association’s Section on Dispute Resolution. Check out its new online resource launched in 2009, a national clearinghouse of mediation ethics opinions at www.abanet.org/dispute/clearinghouse.html.

Best Career Criteria?

Best career - with few jobs and those only with much effort to establish your reputation and niche?

Yes, mediation is a cool occupation, very satisfying when all goes well and very stimulating in all cases. There is always more to learn - something I look for in a job. It is also somewhat isolated. Many mediators work alone or spend much of their time working independently. If you are tired of office politics, this job is for you. If you want someone to talk to when you break for coffee, maybe not.

I wonder what it takes for US News & World Report to label an occupation "less than best?"

Join the fun, but don't give up your day job.

Mediator

I think Mediators help younger childern.I think Mediators help childern that been in DCF or are. Even if the child or childern are not they help.

ADR: The Next Generation at ABA Dispute Resolution Conference this Spring

I am happy to say that I have been employed as a full time mediator since graduating from Cardozo Law School two years ago. I was really excited to see that Mediation on the Best Career List of 2009.

From my experience, finding a job as a mediator takes patience and alot of networking. You need to work really hard and make as many contacts as you possibly can. Joining local dispute resolution listserves, joining local and national dispute resolution organizations and most importantly, getting as much training as possible.

A few of my colleagues (from NYSDRA, AAA and the Weschester Mediation Center) will be presenting with me at the ABA Dispute Resolution Section Conference in April in New York City. We will focus on resources for people who want to enter into the field of mediation. In addition, we will talk about the "Next Generation" in the field of ADR and what practitioners need to know about working with recent graduates (from Generation X and Y). Please come join us!

Mediation as one method of conflict resolution, and access is barely restricted

One issue for mediators-to-be is that mediation is only one method of conflict resolution, or alternate dispute resolution(ADR). Other methods are Arbitration and outright negotiation and related activities such as neutral fact finding, case evaluation, and the services of an ombudsman. Outside of ADR and the courts, there is a range of mental health-oriented solutions to conflict including individual psychotherapy and group therapy.

Within the field of mediation itself,there is a continuum of styles, with the role of the mediator being the variable. That is, some mediators propose solutions and work to secure agreement, where others encourage the participants to develop solutions.

For those who wish to make mediation a career, choices of style need to be made. These choices are similar to those of other disciplines such as doctors who decide early on their specialty, even if their speciality is sometimes the general practice of internal medicine. Lawyers decide whether to work on civil or criminal cases, etc.

One reason that there are more mediators than can be gainfully employed is that the profession has not yet devised a way to control the number of people trained, as the doctors and lawyers do with their medical schools and law schools.

With so many people who wish to learn mediation skills for their own personal use, as well as to volunteer for external mediation, the market for paid mediations will remain slim. Very few people go to medical school or law school so they can treat or represent their families or volunteer as pro bono medics or lawyers.

Nonetheless, given the level of conflict in the world, there is a demand for people with the skill to resolve conflicts, inlcuding mediators.
