disability denial

Yes, the system sucks. Live in the state of TN.I too got denied with breast cancer. Mastecomy and now I have to get a lawyer for what so they can get 25% when ever I get approv. Every time I call Social security they say to give them 120 days. My first denial was due to my mastecomy has not reoccured. Don't no living person want cancer to return but still disable to work. Having treatments for 1 year. Is that considered a disability.

SSDI Still What A Mess

Dear Representative,

My sister, Sheila XXXXX, lives New Jersey . She is 45 years old and is presently unable to work due to a multitude of medical conditions. Sheila has applied for Social Security Disability in Nov 2007 and has been told in the past due to her age she would be unlikely to receive benefits. It appears that Sheila's disability determination is based upon her age and not multiple medical physicians' opinions and her conditions.

Sheila was infected with HIV through her husband(ex) and diagnosed in 1997 and continued to work. In 2005, Sheila was diagnosed with severe Atherosclerosis. Due to this condition she has a left iliac and abdominal aortic stents with additional stenosis. Sheila has suffered multiple Transient Ischemic Attacks, TIAs/mini-strokes since 2004. She has severe neuropathy bilaterally in both hands and feet as well as a multitude of other medical conditions. Sheila continued to work until June of 2007.

August 2008 she was diagnosed with aggressive non-hormonal cancer in her left breast. Sheila underwent surgery and had lymph node removal in her left underarm. Post her surgery she underwent aggressive chemotherapy and radiation for approx. a year.

Due to her multiple medical conditions and medications it is difficult for Sheila to complete simple activities such as opening a jar and walking around the block. Sheila is easily fatigued and has other side effects that limit her daily activities. I have enclosed a copy of the letter prepared by Sheila's attorney. The letter is addressed to the Social Security Hearing Director and contains Sheila's detailed medical history and additional conditions. There are multiple physicians that state Sheila is unable to perform sustained work and is disabled. Sheila's presently takes the following medications for her medical conditions: Dilaudid, Hydromorphone, Oxycodone, Crestor, Plavix, Truvada, Reyataz, Flexeril, Omeprazole, Lexapro, Ativan.

Currently an on the record decision was not approved.

We would appreciate any assistance you could provide Sheila with the Social Security Disability process. Please feel free to contact me, XXX-XXX-XXXX

Sincerely,

Cheryl I.

Dear Hard Working Individual,

It is unfortunate these days that people like my sister who have worked since they were 18 and paid into the system have to fight for years to receive "YOUR" benefits that is IF you receive them. So, where is Obama? They have the same birth date, I wonder if that would help her or does she need to get another chronic and/or debilitating illness? God Help Us!!!

The best of luck to us all,

Cheryl I.

Disability continued

unkown and disabled of PA:

I completly understand where you are coming from. My husband became disabled at the age of 23 due to a car accident. We have been fighting with disablity for 3 years. All his medical records show that he has had a 3 level fusion, aherinated discs that cannot be fixed, all the same symtoms that you have plus some. We finally got a court date and he had been approved. Now, we wait 2 weeks to 90 days for a check. It is ridiculous that they make you wait, deny you two times, and then about 6 months after that, you finally get a court date for 6 months later. Then make you wait even longer for a check. We were told once the decision of the court comes in, took about 2 months for the letter, the check (back pay) will take between 2 weeks to 90 days. What a time frame.

i think the whole system is screwed up it takes up to 2 years if your denied at the first level. mean time your kids go without. but wait the state says you must take care of your kids if you cant work anymore. what a joke this country is coming to. i have degenerated disc diasease and stenosis of the spine severe with 2 bulging disk with a torn nerve in the lumbar region and take 3 shots of insulin 90 units a day with 3 diffrent types of pain killers. i have tingling down the right side of my leg and numbness in my legs. i was told i need a fusion but i dont have 60 thousand dollars and the surgen just keeps putting me off. all this is documented on medical records also. so i applied for disability ssdi 6 monthes later im still waiting for an answer from them. yes i have lawyer. i know ill get denied because every body does if you dont have cancer and your not dieing you will probally get denied. but why should thease people care your the one who has to feed your kids and put clothes on their back side with no income. i call them hitlers s.s working for the state. i bet their relatives they know get disabled are approved right away threw the so called system. yes i have worked for 28 years and im 44 i drove tractor trailer until it got so bad i coulnt work. well wish me luck and god bless the troops who fight every day so we can stay free in this country and fight for the things we believe in and what we should get as a people in this country.
