Sparks was wrong when he mis-applied Bakke and was overturned by the Fifth Circuit in Hopwood.

He's wrong here, too.

And the so-called Republican Texas Attorney General should have taken a hint from the Democratic AG who refused to defend UT in Hopwood.

This preferential admissions system is raw racial poison, and Texas' AG is encouraging its spread.

He should be ashamed.

People of all races should be treated fairly. The most qualified should be admitted. If that means that Asians get 25% of the spots even though they are only 6% of the population, then it is still fair because they are the most qualified. Race based admissions are unfair to unqualified candidates that end up with a ton of student loan debt even when they don't graduate or can't get good paying jobs because they lack the ability. It is far better to only admit the most able.

that John Roberts would like to overturn this ruling. He doesn't care much for precedent.
