I love it... the federal government, under George W. Bush superseded states rights in 2002 by basically forcing this sick and despicable law down our throats (this pathetic corporate giveaway) and not a peep from the right-wing peanut gallery. Of course, there was very little argument when states rights were trampled when the Supreme Court superseded Florida's rights to recount all the ballots, so this is nothing new from the Republicans

My only regret on not finding this article sooner is that I was not able to speak my peace back when this was relatively fresh in all our minds... but alas, I am doing research on this very subject and no thanks to our corporate owned media, I had not heard of this lawsuit being tossed out.

It doesn't surprise me in the least... the last thing these corporate clowns want is an informed and critical citizenry, no wonder these same people are so up in arms about Obama being elected... guess that means that their plan hasn't quite worked out the way they expected, but then again, this November will tell whether people have learned anything over the last two years? To see through the right-wing propaganda of the corporate owned media with the lead cheerleaders being Cluster Fox!

I am a special education teacher. I love my profession and believe in my students' ability. Although I believe in them, I still differentiate instruction to meet their learning needs and help them remediate skills.

How can our government expect us to differentiate, to individualize, and to modify our instruction all year but, at state testing time, all students are given the same assessment? It does not make sense.

I agree we need to be accountable to our students and families; however, we need to be required to show growth for that student based upon THEIR needs and level of development. If they were on grade level, they would not necessarily be special education. It is not fair to push them all year. Encourage them to work hard and do their best. Teach them to use their resources and ask for help if they need it; and then when the stakes are high, leave them out on their own.

Education is supposed to help our kids be successful in society. How many of you have bubbled in a worksheet at your professions lately?
