These Republican a s s h o l e s in Congress actually tried to find a loophole to block nominees while they were UNDENIABLE ON RECESS by sending the B team to hit a gavel for 30 seconds every 3 days. No I mean literally 30 seconds. No work done, no bills discussed just hit a gavel and leave.

I don't know about you but that doesn't sound like they were following the intent of the Constitution. It sounds like they are again playing games at a time when we need the games to stop. This is not governing the way our fore fathers intended and no one should be shocked that Obama would try to fill positions sitting vacant for years while Congress is undeniably on holiday recess.

So by your logic, the President can make a "recess" appointment when Congress is away for a weekend.

Really? I think you are making this up. Considering the source, I suspected something was being taken out of context. It also raised red flags as it seems far fetched she would send the Supreme Court a letter, Since the radical who wrote this did not provide a source, I googled to try to find the source of the claim. I have found numerous cases of extremists providing the same quote but no one provides any proof she said it, the entire quote she supposedly said, or where she supposedly said this. So this appears to be the normal way the GOTP works: totally made up

Gimme a break. Silly when Dems did it, silly now. You're just mad Obama finally had balls to cut through such obstructionist BS. And I don't recall you or any of your condoning Dems doing it. Please. (Nor is gaveling/closing tactic what Justice Kagan meant by "in session".) Yours is an absurd reading of Constitution and illogical to boot.

I see cannot find a copy of the Resolution by Congress, adjourning the Session. If the Executive Branch cannot produce that, then Congress is still in Session, and any appointments would be unconstitutional.

Maybe if the Republicans would allow the Senate to vote up or down on some of the appointments President Obama has sent to it for approval, he wouldn't have to press so hard on his power to make recess appointments.

I mean, with the Republicans doing all they can to make the government dysfunctional, it's a little disingenuous to criticize President Obama for trying to work around their obstructionism.

As I pointed out in my most recent post on my blog, the President's actions are unconstitutional- first, he doesn't get to decide when the Senate is in session; and second, the Senate actually met the same day as the appointments for a session (the calender entry for that is on my blog).
