XD If a Republican nominee were to say that he/she believed that members of a particular race were more qualified to sit on the federal bench, you'd be going bananas and screaming racism! But it's okay, as long as the unfair bias is directed at whites? A Done Deal

Judge Sotomayer has the intellectual capacity to know that laws may be right for one point in US history and not right for another. She understands that the constitution is a living document, adaptable to the times and flexible enough to lean when necessary to favor those who have been disfavored by fate or by the oppression of the powerful owner class. She also knows that arrogant America is not always right -- laws from other nations on this planet also are to be respected and incorporated into judges' rulings.

Thanks to the wisdom of the people of Minnesota, those of you who would keep her off the court because she is a latina are now outvoted. It's a done deal.

Well said Robert. Apparently though, too nuanced to combat the idiotic "60% fail rate" slogan -- either that or half of these commentors didn't actually read your article.

Never mind, Robert. You can't teach some people simple math. I made the same case to a friend and ideological sparring partner, and although he's otherwise pretty smart, he couldn't digest the truisms that you're reporting. Too emotionally invested, I guess.

Silly 60%

Right, and the WaTimes is so much more credible. If the media matters analysis is so dishonest, it should be easy enough to prove wrong. Post your stats that prove the 60% reversal rate is somehow out of the ordinary.

Sure the 60% number is accurate with respect to her cases heard by the Supreme Court, but if that is some sort of qualificaiton rubric then it appears most appellate judges would be unqualified. So what is the significance of the 60% number?
