I taught for many years and I know for a fact that many people in education used illegal drugs. From all levels.....custodians, teachers, administrators.

just cause for drug testing?

Lingle should not have given in... if the teachers agreed to a pay raise with the stipulation that they'd also agree to drug testing and then backed out, they broke a contractual agreement.

I think there has to be just cause in order to establish such testing. Some schools have drug testing because an existing problem has been identified. In these cases I think it's justified for both students and teachers to submit to testing.

Where no problems have occurred then it seems foolish to waste the time and money to curb a non-existing problem.

Weed

Do people realize how many teachers would be fired? My guess - 60% of ALL teachers smoke weed.

Presumptions

Attention American shoppers, er, citizens.

We have a little lost child over in the public education department. He says his name is the presumption of innocence and he's here with his little sister, the Bill of Rights. They say they belong to all the American people. His sister keeps reminding the management that bare minimum due process requires that there be a reasonable, articulable suspicion of crime before people can be legally detained,questioned and searched. She also reminds us that any gathering of evidence must be based upon such a suspicion or it is inadmissable in any competent court in our jurisdiction.

Please come to the lost and found and pick up your children, America. And remember, this offer extends to all 50 states and to all professions, even public school teachers.

Hawaiian teachers or the U.S. Congress, they should both be tested and any positive results published. Both will never happen, not because of the constitution, because half of both groups are heavy users.

Judge is Ignorant of the Problem

The Judge's opinion epitomizes the lack of education relative to substance abuse and effective management methods.

1. Substance abuse is pervasive, 10% of all employed individuals abuse drugs and over 75% of all drug abusers are employed.

2. Detection and deterrence are recognized as requirements in order to manage substance misuse. Random drug testing is the single most effective tool in this area.

3. Random drug testing is legal and the decision will be reversed.

No, testing on individuals who drive for a living, or fly, or perform surgery or whatever may not be unconstitutional, since the Constitution clearly defines my rights as ending where your rights begin. A teacher who smokes pot in the privacy of his or her own home, while not on school grounds has a right to refuse testing; an airline pilot does not. However, a blood test is a more accurate assessment of whether someone is under the influence within the last three days, whereas a urine or hair test only shows they used sometime within a ridiculously long period of time.

Nonetheless, computer-aided performance testing, before a worker is allowed to fly that plane or drive that bus or operate that loom is still a better indication of whether he or she is fit to perform the job. The data is easily verifiable.
