Veterans Groups Sue Bush Administration Over Delayed Benefits Claims

Posted November 10, 2008

Veterans are hoping, however, that the judge will recognize that a dramatic change is needed—and that a lawsuit may be the only way to do it.

"We are bringing this suit as a last resort," says Donald Overton, executive director of Veterans of Modern Warfare. "Everyone knows that the delays are terrible, but nothing has changed."

Veterans Disability Benefits

I served in the US Army for 8yrs and I was in the gulf war for the entire campaign and I was stationed in Camp Montery Kuwaitt where the oil wells burned. We constantly had to inhale oil smoke for months and I aquired severe cluster headaches and God knows what else, but to this day I suffer from these headaches and I filed claim after claim and they finally olny granted me 10% disability when Iam clearly qualified for at least 30% I appealed and was told that it would take up to two years to hear from the VA. This is absolutely ridiculas, and something needs to be done.

I can"t give up

I filled a claim for unemployability for my service connected PTSD disability was given C&P by Va Hospital Washington, DC. The doctor said in his report that i was unimployable and the Baltimore Regional office denied my claim anyway without even using the C&P results to rate the claim. I stated this in my request for a DRO in September of 2007. I still have not heard a darn thing for them. It's frustrating as hell yet I can't give up as they seem to wank me to. Does any one know if two years is or is not a resonalble waite concidering the back log of claims VA has. I thought I at least would have been giving a notice for a hearing by now.

chicago va

i have also been trying to get my disability increased from the chicago ve for 8 years to no avail. my case id presently before a dro. i have been bedridden for 9 years and cant walk. i served 20.5 years (14 years active and 6.5 active reserve) in the navy and have done nothing else. the va says my condition is not service related but yet i did nothing but serve in the navy. i have been trying to get a proper rating as i cant work and i was not like this before i went in the service, now i have a hard time supporting my family and the 30 percent disability i get from the va is taken out of my navy regular retired pay. no one seems to care or want to help. my wife helps me but she is strung out and cant work except part time as she has to take care of me. i cant even paint my house nor can i afford it. i wish the chicago va would learn some other word except no.
